Terms & Conditions

Last updated: 18 October 2026

1. Introduction and acceptance

These Terms & Conditions govern use of the HeyGuest website and platform. HeyGuest is operated by TL Romburgh as a sole proprietor in South Africa. By creating an account, subscribing or using the service, you agree to these Terms. If you do not agree, do not use the service.

2. What HeyGuest provides

HeyGuest is a software service that allows accommodation hosts to create and share digital guest guides. Guides may include accommodation details, Wi-Fi information, check-in instructions, house rules, emergency information, local recommendations, photos, videos, contact details, maps and links.

Guests generally access guides by web link or QR code without creating a HeyGuest account. HeyGuest does not provide accommodation, travel, hospitality, booking, emergency response or guest messaging services. External links take users to third-party services governed by their own terms.

3. Eligibility and accounts

You must be at least 18 years old to create a HeyGuest account. You must provide accurate information and keep it reasonably up to date.

You are responsible for protecting your login credentials and promptly notifying hello@heyguest.co.za if you suspect unauthorised access. Responsibility for activity through an account depends on the circumstances and applicable law; nothing in these Terms excuses HeyGuest from its own legal responsibilities.

4. Host responsibilities and guide content

You are responsible for your accommodation business, the accuracy and suitability of your guide, and compliance with laws, licences and obligations that apply to you.

You must have the necessary rights and permissions for content you upload or publish, including photographs, text, logos, personal information and links. Do not upload unlawful, misleading, infringing, abusive or harmful content, or content that creates a security or privacy risk.

Guides shared by link or QR code may be publicly accessible. Use available PIN-protection features where offered, and do not put alarm codes, access codes, passwords or sensitive personal information in publicly accessible sections.

5. Ownership and licence to use content

You retain ownership of content you upload, subject to rights held by others. You grant HeyGuest a limited, non-exclusive permission to host, store, reproduce, display and process that content only as reasonably necessary to provide, secure and support the service.

We will not use your photographs or guide content in HeyGuest marketing, social media or case studies without your permission, unless the material is already public and use is otherwise lawful. You are responsible for securing permissions from people shown in photographs or identified in content.

6. Plans and features

Free plan — R0

The Free plan is intended to remain available indefinitely and includes one property/guide with the Free features shown on the HeyGuest website. The feature list displayed on the website at the time of use applies.

HeyGuest Plus — R129 per month

HeyGuest Plus is a monthly subscription with the paid features and limits displayed on the HeyGuest website at the time you subscribe. Prices are stated in South African rand (ZAR). International customers may incur currency conversion or other fees charged by their payment provider or financial institution.

Features and interface may evolve. We will give reasonable notice of significant changes, particularly changes materially affecting paid features, and will not remove rights that cannot lawfully be excluded.

7. Free trial

HeyGuest may offer a 14-day trial of HeyGuest Plus without requiring a payment card. During the trial, the user can access the Plus features included in the offer. At the end of the trial, the account reverts to Free unless the user actively subscribes to Plus. The trial does not automatically convert into a paid subscription and no subscription charge is made merely because the trial ends.

8. Subscriptions, payments and renewal

HeyGuest Plus is billed monthly. Payments will be processed through Paystack or another supported payment provider once configured. The payment provider's checkout terms and privacy notices also apply.

By actively subscribing, you authorise recurring monthly charges at the price disclosed at checkout until you cancel. We will not debit your account or request additional payments outside the payment authorisation and checkout terms you agreed to. Provider fees or currency conversion are determined by that provider or your financial institution.

9. Cancellation and downgrade

You may cancel at any time. Cancellation stops the next renewal; Plus features generally remain available until the end of the current paid billing period.

After the paid period ends, the account returns to Free. Existing guides and Free-plan information are intended to remain available. Plus-only content or features may be hidden or disabled for the host and guests while the account is on Free. Content is not intended to be deleted merely because of a downgrade. Upgrading again restores access to eligible Plus features while the subscription is active.

Cancellation does not normally result in a pro-rata refund for unused time, subject to the Returns & Refund Policy and mandatory legal rights.

10. Failed payments

If a recurring payment fails, we may notify you and allow a 7-day grace period to resolve the payment before restricting Plus features. If payment remains unresolved after that period, the account may be limited to Free access and Plus features may be hidden or disabled. Existing guides are intended to be retained. This process is subject to the payment provider's capabilities and applicable law.

11. Price changes

We may change subscription prices. We will provide advance notice before a new price applies to an existing subscription, where reasonably practicable and as required by law. You may cancel before the new price takes effect if you do not wish to continue at that price.

12. Refunds

Refunds and billing corrections are governed by the HeyGuest Returns & Refund Policy. Nothing in these Terms removes any cancellation, refund or other remedy required by applicable law.

13. Availability, support and service changes

We use reasonable efforts to keep HeyGuest reliable and address significant technical issues, but uninterrupted or error-free availability is not guaranteed. Outages may occur because of maintenance, infrastructure, security incidents or third-party services.

For support, contact hello@heyguest.co.za. We aim to respond as soon as reasonably possible but do not promise a fixed response time.

If HeyGuest is permanently discontinued, we intend to give as much advance notice as reasonably possible, provide one additional month of access without charge after the closure notice (with no new monthly renewal during that period), and allow a reasonable opportunity to save guide content where technically possible.

14. Suspension and prohibited use

We may restrict or suspend access where reasonably necessary to address serious or repeated breaches, unlawful use, security risks, suspected fraud, threats to the platform or other users, or legal requirements. Where appropriate, we will provide notice and an opportunity to address the issue. We may remove or restrict content that appears unlawful, harmful, infringing or to present a security or privacy risk.

15. Intellectual property complaints

If you believe content on HeyGuest infringes your rights or is unlawful, email hello@heyguest.co.za with your contact details, the relevant guide or URL, a description of the material, the basis of your complaint and supporting information. We may request further information and restrict or remove content while investigating. Serious or repeated infringement may lead to suspension or termination. This process does not replace any statutory notice-and-takedown procedure that may apply.

16. Privacy

Our handling of personal information is described in the HeyGuest Privacy Policy, which forms part of the documents governing use of the service.

17. Account deletion

You may request account deletion through an available account setting or by contacting hello@heyguest.co.za. Our intended process includes a 30-day cooling-off period, during which you may cancel the request and recover the account. After the period, account and associated guide content are intended to be deleted, subject to information retained for legal, security, accounting or legitimate business purposes. Availability of self-service controls and the precise workflow depend on platform implementation. Routine backups may not be immediately purged. Downgrading to Free does not delete an account.

18. Disclaimer and liability

To the extent permitted by law, we do not guarantee that the platform will always be available, guide content will be accurate, third-party links will work, or use of the service will produce bookings, reviews, revenue or other commercial outcomes. Hosts remain responsible for their business and the information they publish.

To the extent permitted by law, HeyGuest will not be liable for indirect or consequential loss arising from use of the service. Where lawful, liability relating to a paid subscription may be limited to fees paid for that subscription in the 12 months before the event giving rise to the claim. Nothing excludes or limits liability or consumer rights where doing so would be unlawful.

19. Indemnity

To the extent permitted by law, you agree to cover reasonable claims and costs arising from content you upload, unlawful use of HeyGuest, breach of these Terms, or infringement of another person's rights through your content. This does not apply to the extent a claim results from HeyGuest's own unlawful conduct or where such an allocation is prohibited by law.

20. Disputes and governing law

If you have a concern or dispute, first contact hello@heyguest.co.za so we can try to resolve it informally. If it cannot be resolved, either party may pursue appropriate formal dispute-resolution processes or legal remedies available under applicable law.

These Terms are governed by South African law, subject to mandatory consumer protections that may apply to international customers. Nothing prevents a consumer from exercising rights that cannot lawfully be excluded.

21. Changes and general terms

We may update these Terms from time to time. Material changes will be notified where appropriate. If a provision is held invalid or unenforceable, the remaining provisions continue to apply to the extent permitted by law. These Terms, the Privacy Policy and the Returns & Refund Policy together describe the agreement regarding use of HeyGuest, subject to mandatory law.
